Crypto sector achieves first victory against the SEC ⤵️
Crypto asset manager Grayscale has achieved an important stage victory against the US securities regulator SEC. Its application for approval of a bitcoin ETF was wrongly rejected, a U.S. appeals court has ruled.
- An appeals court in Washington has ruled that the Securities and Exchange Commission (SEC) wrongly denied an application by crypto asset manager Grayscale Investments for approval of an exchange-traded fund that tracks the price of Bitcoin, according to concurring media reports.
- The court stated that the SEC's order should be vacated. This means that the SEC must reconsider and reevaluate Grayscale's application for a bitcoin exchange-traded fund.
- It also says that Grayscale has provided compelling evidence that its product has similarities to the SEC-approved bitcoin futures ETFs. The underlying assets of both product categories are closely correlated, and the joint surveillance agreements with the Chicago Mercantile Exchange are "identical."
